These Terms of Use (“Terms”) govern your access to and use of pocketsandfriends.com (the “Site”), operated by Pockets & Friends (“we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Who May Use the Site

The Site offers stories, songs, video lessons, mini lessons, and games intended for children, to be enjoyed with the guidance of a parent or guardian. If you are under 18, you may only use the Site, and in particular create an account or make a purchase, with the involvement and consent of a parent or guardian. Accounts should be registered and managed by an adult on behalf of a child.

2. Accounts

Some features, such as saving reading progress, earning points, levels, and badges, or purchasing products, require an account. You agree to provide accurate information when registering, to keep your login credentials confidential, and to notify us of any unauthorized use of your account. You are responsible for activity that occurs under your account.

3. Acceptable Use

When using the Site, you agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms.
• Attempt to gain unauthorized access to any account, system, or network connected to the Site.
• Interfere with or disrupt the Site, including through automated scraping, bots, or exploits of the points/leveling system.
• Upload or submit content through reviews or comments that is unlawful, abusive, obscene, or infringes the rights of others.
• Reproduce, resell, or exploit any part of the Site or its content for commercial purposes without our written permission.

4. Intellectual Property

All stories, characters, illustrations, audio, video, games, logos, and other content on the Site (“Content”) are owned by Pockets & Friends or our licensors and are protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Content for personal, non-commercial entertainment purposes only. You may not copy, modify, distribute, sell, or create derivative works from the Content without our prior written consent.

5. Reviews and User Submissions

If you submit a review, comment, or other content to the Site, you grant us a worldwide, royalty-free, perpetual license to use, reproduce, display, and publish that content in connection with operating and promoting the Site. You are solely responsible for content you submit, and you confirm you have the right to submit it. We may remove or refuse to publish any submission at our discretion.

6. Points, Levels, and Badges

The Site includes gamified features such as points, reading levels, and badges awarded for reading, listening, watching, and completing games. These are provided for entertainment purposes only, have no monetary value, cannot be exchanged, transferred, sold, or redeemed for cash or any other consideration, and may be adjusted, reset, or discontinued by us at any time without liability.

7. Purchases

The Site’s Shop may offer physical or digital products for purchase. By placing an order, you agree to provide accurate payment and billing information and authorize us (through our payment processor, Stripe) to charge your payment method for the total order amount, including applicable taxes and shipping. We aim to display accurate pricing and product information but are not liable for typographical or pricing errors, and we may cancel orders affected by such errors. Order acceptance, shipping, and any returns or refunds are subject to the policies shown at checkout at the time of your order.

8. Advertising

The Site may display advertising, including through Google AdSense and other third-party advertising networks, to support the free content we provide. Our total liability for any claim arising from these Terms or the Site will not exceed the amount you paid us, if any, in the twelve months preceding the claim.

You agree to indemnify and hold harmless Pockets & Friends from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Site or violation of these Terms.

13. Termination

We may suspend or terminate your access to the Site or your account at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to other users, us, or third parties.

We may update these Terms from time to time. Material changes will be reflected by an updated “Effective date” at the top of this page. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law principles, without prejudice to any mandatory consumer protection rights you may have under the laws of your country of residence.
